INFORMATION CLAUSE

RIMSA Plus Spółka z o.o. presents the following information required by art. 13 REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation ) (Official Journal of the European Union of 04.05.2016) and concerning the processing of personal data.

The purposes of processing and the legal basis for the processing of personal data

  • consideration by RIMSA Plus of an offer to conclude a contract or activities preceding its submission,

Legal basis: consent of the data subject; indispensability to take action at the request of the data subject before concluding the contract;

  • performing by RIMSA Plus activities related to the conclusion, performance or termination of the contract and the performance of other activities related to the contract, including activities preceding its conclusion;

Legal basis: indispensability to perform the contract to which the data subject is a party, or to take action at the request of the data subject, before concluding the contract;

  • issuing VAT invoices or other accounting documents by RIMSA Plus;

Legal basis:

  1. a) indispensability to perform the contract to which the data subject is a party,
  2. b) the necessity to fulfill the legal obligation of RIMSA Plus;
  • running by Rimsa Plus:
  1. Accounting books and other accounting devices specified in legal provisions regulating accounting matters;
  2. Records of transactions required by law regulating tax issues;

Legal basis: indispensability to fullfil legal obligation of Rimsa Plus;

  • Ensuring safety of persons or protection of property or r production control or confidentiality of information, the disclosure of which would expose RIMSA Plus to detriment by introducing special supervision over the workplace or work area in the form of technical means enabling image registration (monitoring) – if RIMSA Plus applies monitoring and maintaining privacy and dignity of people and in accordance with applicable law;

Legal basis: indispensable for purposes arising from legitimate interests pursued by RIMSA Plus, consisting in ensuring the safety of persons and property, production control or secret information, disclosure of which could expose RIMSA Plus to a detritment

  • Investigation or defense regarding claims or rights of Rimsa Plus;

Legal basis:indispensability for purposes arising from legitimate interests pursuit by RIMSA Plus, consisting in the right to defend their position and participate in proceedings;

  • Considering your potential complaints and claims;

Legal baisis: the legitimate interest of Rimsa Plus , consisting in examining the claim being the subject and defending against potential claims,

  • Transfer your data to archive after completion legal relations resulting from the above mentioned purposes of processing;

Legal baisis:

  1. Indispensability for purposes arising from legitimate purposes pursued by RIMSA plus; The necessity to fullfil legal obligation of Rimsa Plus.

Source of personal data

RIMSA Plus obtains your datas:

  • Directly from data subject;
  • From publicly available registers or databases such as:
  1. Central Registration and Information on Business;
  2. National Court Register;
  3. National Business Registry Number;
  • If RIMSA Plus has from your side appropriate authorisation required by the law – business information offices;
  • From commercial law companies or operating in other legal forms being RIMSA Plus customers;
  • From Rimsa Plus operating system of video monitoring

The period during which personal data will be processed

The processing time of your data depends on the purpose of which it was collected and processed, from the regulations and consents granted by you. Rimsa Plus processes data related to:

  • the contract or other legal act – for the time necessary to consider the offer, preparation for the performance of the given activity, and if it takes place – for the time necessary to perform it. If the action did not take place, the data is processed for 3 years from the date of data collection;
  • archival data – after the expiry of a given legal relationship (ie, contract) personal data regarding the activities of these persons as entrepreneurs or on behalf of the entrepreneur, institutions or organizational units are processed for 6 years and other personal data of physical persons (consumers) are processed for up to 10 years, unless the law provides for a shorter period. If there is a dispute, a lawsuit or other proceedings (especially criminal proceedings), the archiving period will be counted from the day when the dispute is finally concluded, and in the case of many proceedings of the final termination of the last one, regardless of how it ends, unless the law provides for a longer period data storage or longer period of limitation for the claims / law concerned;
  • by a court decision – data may be processed up to 10 years from the date of issuing a legally valid decision terminating the proceedings ;
  • consent of the data subject – for the time indicated in the declaration of consent, in any case – until the consent is withdrawn;
  • obtaining data from publicly available registers or business information offices. The processing period of the data so obtained depends on the purpose of the processing and is subject to the rules set out above in this section of the Information Clause, whereby data obtained from business information bureaus are deleted after 90 days;
  • biometric data in the form of image obtained in connection with the use of video monitoring on the premises of RIMSA Plus; data are stored for up to 3 months and in the case where the data is evidence in the proceedings or RIMSA Plus has acquired knowledge that they can be evidence in the proceedings, the storage period is extended until the final conclusion of the proceedings.

Categories of recipients of personal data

RIMSA Plus may transfer personal data to entities or bodies:

  1. a) which are authorised by the law,
  2. b) to which the transfer of data is necessary for the performance of a specific activity related to the contract concluded by the data subject; e.g. contracts for work, transport or forwarding;
  3. c) which data may also be provided on the basis of your consent or authorization,,

The rights of the data subject

You have the right to access your data and the right to demand rectification, deletion and processing restrictions.

To the extent that the basis for the processing of your personal data is the premise of the legally legitimate interest of the administrator, you have the right to object to the processing of your personal data.

To the extent that the basis for the processing of your personal data is consent, you have the right to withdraw your consent. Withdrawal of consent does not affect the lawfulness of the processing that was made on the basis of consent before its withdrawal.

To the extent that your data is processed for the purpose of conclusion and performance of the contract or processed on the basis of consent – you also have the right to transfer personal data, i.e. to receive from RIMSA Plus your personal data, in a structured, commonly used machine-readable format. You may send this data to another data administrator. The right to transfer data does not apply to data that is the trade secret.

You also have the right to lodge a complaint with the supervisory body dealing with the protection of personal data.
